Where Are They Now of the Day: Jimmy McMillan, eccentric perennial candidate and founder of the Rent Is Too Damn High Party, is facing the possibility of being evicted from his East Village residence because — according to McMillan — his landlord thinks the rent is too low.

McMillan, infamous for complaining that the rent is too damn high while living comfortably in a rent-controlled apartment that costs $872 a month, says his landlord, Lisco Holdings, is attempting to kick him out because “they want more money.”

But a lawyer representing the building’s owner says McMillan violated the terms of his lease by having a primary residence elsewhere. “This is a case where the landlord alleges that it’s not the tenant’s primary residence,” said attorney Robert Goldstein.

McMillan, who is planning to run for president in next year’s election, says he uses his Brooklyn apartment (where he told the New York Times he lives rent free) as his office and party headquarters, and that the landlord’s claim is merely a ploy to get him thrown out. “It’s a trick they all play. I’m not going to let them get away with it. You don’t tell an American how to live,” McMillan is quoted as saying.

McMillan’s case is pending in Housing Court where he plans to file a $70,000 counter-suit.
